TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
Indemnification

Termination

Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Services will be governed by the laws of the State of California, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
General
These Terms, together with the Privacy Policy and any Additional Terms you agree to when using particular features of the Services, constitute the entire agreement between you and Monterey Nutra regarding the Services. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them without restriction.
